END USER LICENSE AGREEMENT (EULA)
NeuroQuest
This End User License Agreement (“Agreement” or “EULA”) is a legal agreement between you (“End User”, “you”, or “your”) and Gabriel Peniche Soares, operator of NeuroQuest (“Licensor”, “we”, “us”, or “our”), regarding your use of the NeuroQuest mobile application (“Licensed Application” or “Application”).
By downloading, installing, accessing, or using the Licensed Application, you agree to be bound by this EULA. If you do not agree to this EULA, do not download, install, access, or use the Licensed Application.
1. ACKNOWLEDGEMENT
This EULA is concluded between you and the Licensor only, and not with Apple Inc. (“Apple”). The Licensor, not Apple, is solely responsible for the Licensed Application and its content.
You acknowledge that you have had the opportunity to review the Apple Media Services Terms and Conditions. This EULA does not provide for usage rules that conflict with the Apple Media Services Terms and Conditions as of the effective date of this EULA.
2. SCOPE OF LICENSE
Subject to your compliance with this EULA, the Licensor grants you a limited, non-exclusive, non-transferable, revocable license to use the Licensed Application on any Apple-branded products that you own or control, and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
The Licensed Application may also be accessed and used by other accounts associated with the purchaser through Family Sharing or volume purchasing, where applicable and permitted by Apple.
You may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, decompile, disassemble, or attempt to derive the source code of the Licensed Application, except to the extent such restriction is prohibited by applicable law.
3. PURPOSE OF THE APPLICATION
NeuroQuest is an educational application designed to support the study and review of neurology, neurosurgery, and related medical topics through questions, explanations, performance tools, review features, and other educational resources.
The content provided in the Licensed Application is for educational and informational purposes only. It is not intended to replace professional medical judgment, clinical guidelines, formal medical training, or consultation with qualified healthcare professionals.
The Licensed Application must not be used as the sole basis for diagnosis, treatment, clinical decision-making, emergency care, or patient management.
4. SUBSCRIPTIONS AND IN-APP PURCHASES
The Licensed Application may offer auto-renewable subscriptions and/or other in-app purchases that provide access to premium features, educational content, analytics, or additional tools.
All purchases, billing, renewals, cancellations, and refunds are handled through Apple according to the terms and policies applicable to the App Store and the Apple Media Services Terms and Conditions.
You are responsible for managing your subscription through your Apple ID account settings. Unless canceled in accordance with Apple’s rules, auto-renewable subscriptions may renew automatically.
5. MAINTENANCE AND SUPPORT
The Licensor is solely responsible for providing any maintenance and support services with respect to the Licensed Application, as specified in this EULA or as required under applicable law.
You and the Licensor acknowledge that Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the Licensed Application.

6. WARRANTY
The Licensed Application is provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory, except to the extent such warranties cannot be excluded under applicable law.
The Licensor is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed.
In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Licensed Application to you, if applicable. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Licensed Application.
Any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the sole responsibility of the Licensor, to the extent required by applicable law.
7. PRODUCT CLAIMS
You and the Licensor acknowledge that the Licensor, not Apple, is responsible for addressing any claims by you or any third party relating to the Licensed Application or your possession and/or use of the Licensed Application, including, but not limited to:
(i) product liability claims;
(ii) any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement; and
(iii) claims arising under consumer protection, privacy, data protection, or similar legislation.
This EULA does not limit the Licensor’s liability to you beyond what is permitted by applicable law.
8. INTELLECTUAL PROPERTY RIGHTS
The Licensed Application, including its design, interface, software, text, educational structure, graphics, logos, trademarks, and other content, is owned by or licensed to the Licensor and is protected by applicable intellectual property laws.
You and the Licensor acknowledge that, in the event of any third-party claim that the Licensed Application or your possession and use of the Licensed Application infringes that third party’s intellectual property rights, the Licensor, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
9. USER CONTENT AND ACCEPTABLE USE
You agree to use the Licensed Application only for lawful, educational, and personal purposes.
You must not use the Licensed Application to:
- violate any applicable law or regulation;
- infringe the rights of others;
- attempt to gain unauthorized access to the Application, servers, databases, or systems;
- interfere with or disrupt the operation of the Licensed Application;
- copy, scrape, extract, redistribute, or commercially exploit the Application’s content without authorization;
- upload or transmit malicious code, spam, or harmful content.
The Licensor reserves the right to restrict, suspend, or terminate access to the Licensed Application if your use violates this EULA or applicable law.
10. PRIVACY
Your use of the Licensed Application is also subject to the NeuroQuest Privacy Policy, available at:

By using the Licensed Application, you acknowledge that you have reviewed the Privacy Policy and understand how data may be collected, used, and protected.
11. THIRD-PARTY SERVICES AND TERMS
The Licensed Application may use or integrate with third-party services, including but not limited to Apple services, cloud infrastructure, authentication services, analytics tools, payment processing, database services, and artificial intelligence services.
You agree to comply with all applicable third-party terms of agreement when using the Licensed Application. For example, you must not use the Licensed Application in a manner that violates your wireless data service agreement, Apple’s terms, or the terms of any third-party service used in connection with the Application.
The Licensor is not responsible for third-party services, content, outages, policies, or practices, except to the extent required by applicable law.
12. LEGAL COMPLIANCE
You represent and warrant that:
(i) you are not located in a country that is subject to a United States Government embargo, or that has been designated by the United States Government as a “terrorist supporting” country; and
(ii) you are not listed on any United States Government list of prohibited or restricted parties.
13. TERMINATION
This EULA is effective until terminated by you or the Licensor.
Your rights under this EULA will terminate automatically if you fail to comply with any of its terms. Upon termination, you must stop using the Licensed Application and delete it from your devices.
Termination does not limit any rights or remedies available to the Licensor under applicable law.
14. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, the Licensor shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to your use of or inability to use the Licensed Application.
Nothing in this EULA excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
15. CHANGES TO THIS EULA
The Licensor may update this EULA from time to time. Updated versions may be made available within the Licensed Application, on the NeuroQuest website, or through App Store metadata.
Your continued use of the Licensed Application after an updated EULA becomes effective constitutes your acceptance of the updated terms.
16. GOVERNING LAW
This EULA shall be governed by and interpreted in accordance with the laws applicable in Brazil, except where local consumer protection or other mandatory laws provide otherwise.

18. THIRD-PARTY BENEFICIARY
You and the Licensor acknowledge and agree that Apple and Apple’s subsidiaries are third-party beneficiaries of this EULA.
Upon your acceptance of this EULA, Apple will have the right, and will be deemed to have accepted the right, to enforce this EULA against you as a third-party beneficiary.
